Detzky, Hunter & DeFillippo, LLC is proud to announce a significant legal victory in the United States District Court for the District of New Jersey, resulting in the successful release of a client who had been detained by U.S. Immigration and Customs Enforcement (ICE).
The client was taken into custody on March 19. In response, our legal team acted swiftly and filed a Petition for Writ of Habeas Corpus in federal court, challenging the legality of the continued detention. The petition argued that the detention was based on a misinterpretation of the Immigration and Nationality Act and constituted a violation of the client’s Fifth Amendment right to due process under the United States Constitution.
Following review, the Federal District Court agreed with our position and ordered the client’s immediate release from detention.
As a result of this ruling, our client has been reunited with their family and will be able to move forward during this meaningful time of year.
This case underscores the importance of protecting constitutional rights and ensuring that individuals are not subjected to unlawful or prolonged detention.
