A Young Man Wrongfully Placed in Deportation Proceedings
Our client, a 23-year-old Mexican national, was brought to the United States by his parents when he was an infant. Having grown up in this country, he had previously been granted Deferred Action for Childhood Arrivals (DACA) by U.S. Citizenship and Immigration Services (USCIS).
Despite his lawful DACA status, he was arrested by U.S. Immigration and Customs Enforcement (ICE) during a routine enforcement operation and placed into detention at Delaney Hall. ICE then initiated removal (deportation) proceedings against him.
Immediate Legal Action
Recognizing the urgency of the situation, our immigration attorneys acted immediately.
Our legal team filed a Petition for a Writ of Habeas Corpus in the United States District Court challenging our client’s detention while simultaneously filing a Motion to Dismiss the Removal Proceedings before the Immigration Court. We argued that placing our client into deportation proceedings was inconsistent with his previously approved DACA status and the protections granted by USCIS.
Another Successful Result
Our efforts produced an outstanding outcome.
Our client was released from ICE detention, and the Immigration Judge agreed with our legal arguments, finding that pursuing removal proceedings under these circumstances was inconsistent and inappropriate given his previously approved DACA status. As a result, the court terminated the deportation proceedings, allowing our client to remain in the United States.
