House Passes Bill Mandating Immediate Deportation for DUI Offenses
August 6, 2025 – Legal Update
On June 26, 2025, the U.S. House of Representatives passed the “Jeremy and Angel Seay and Sergeant Brandon Mendoza Protect Our Communities from DUIs Act”, a bipartisan bill that mandates immediate deportation for any non-citizen convicted of DUI or DWI, regardless of the offense’s severity or circumstances.
The bill, which passed with a 246-160 vote, applies to all non-citizens—including undocumented immigrants, visa holders, and lawful permanent residents (green card holders)—and offers limited or no opportunity for legal appeal. It would amend existing immigration law to make any DUI/DWI conviction a deportable offense, even misdemeanors or past convictions.
The legislation now moves to the Senate and, if passed, will require the President’s signature to become law.
Key Takeaways:
-
Applies to all non-citizens convicted or admitting to DUI/DWI.
-
Covers offenses involving alcohol or drugs under any jurisdiction.
-
Limits most legal relief, resulting in expedited deportation.
-
Raises significant concerns about due process, family separation, and retroactive application.
What This Means:
Immigrants—especially green card holders and visa holders—should be aware that DUI convictions may soon carry automatic and irreversible immigration consequences. If you or someone you know is facing DUI charges, consult with an experienced immigration attorney immediately to understand your rights and options.
